The term “SMRM Innovative Ventures Private Limited” or “Radiant” or “us” or “we” refers to the owner of the website, whose registered office is S-8/835, Prabha Niwas, Lane No. 5 East, Near Old ESI Dispensary, Patel Nagar, Pathankot-145001 (Punjab).  The CIN of the company is U74999PB2016PTC045857. The term “you” refers to our users and viewers of our webpage.

By using this website, you will be subjected to the following terms of use:

If in any manner, you violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any court in India, and you automatically consent to exclusive jurisdiction in venue in such court. Arbitration under this agreement shall be conducted under the rules prevailing under the Indian Arbitration Act. The arbitrator’s award shall be binding and maybe entered as a judgement in any court of competent jurisdiction. 

Electronic Communications

When you visit our website, or make a purchase, or send us an email, you communicate with us electronically. On you doing so we automatically see it as your consent to further receive communications from us electronically. You agree that all agreements, notices, disclosures and other communication that we provide to you electronically satisfy any legal requirement that such communication be in writing.

Indemnification

By using this site, you agree to defend, indemnify and hold Radiant and its affiliates harmless from and against any and all claims, damages, costs and expenses, including but not limited to attorney fees from or related to your use of our site.

Cancellation, Returns and Refunds

Cancellation Policy

We believe in helping our customers as far as possible, our staff goes above and beyond to help and understand customer’s problem. Therefore, we created a very liberal cancellation policy. Cancellation will be easy if the shipment is not yet made for the order, but cancellation charges may apply. (Please refer to the return and refund policy below.)

Unfortunately, we won’t be able to entertain cancellation of orders placed under the same day delivery. Also, orders received on special occasions and with special offers like on Holi, Diwali, Pongal, Valentine’s day, Republic and Independence Day, etc. won’t be possible as these are limited offers and are fulfilled for only selected customers. 

Return and Refund Policy

We personally make sure that each product that we procure, and sell is of the best quality.  To further ensure that all products reach you in best conditions we have partnered with Delhivery. 

In rare event where you might have received a package which is not in good condition, you must not accept it and should call us immediately, so we can arrange a new shipment for you. 

Though extremely rare and unlikely, in any event whereby everything seemed to be fine, but you still receive a product that does not work, i.e. the product has a manufacturing defect. In those unfortunate cases, you will have to visit the Apple Authorised Service Provider for further support. As we will be unable to return the product once it has been delivered to you.

As we mentioned earlier, our team goes above and beyond to understand you and make you happy. Though some scenarios are not under our control and we are also governed by the policies of Apple India. We would always like to know if you experienced an issue with your order, and if possible, we may make an exception and provide you with an alternative. But that would all be on case by case basis and all receipts of Damaged/Defective products need to be notified to us within 48 hours of delivery.

Refunds 

Refunds are possible in the following cases:

1. Cancellation of an order prior to Invoicing/shipment.(Not applicable for Orders with Cashback.)     
2. Where the customer was not available at the time of delivery attempts or refused to collect the delivery, with an exception to scenarios mentioned above. Returns for certain Apple products with serial no.s is not possible since the warranty gets updated post billing.  

For case 2, refund will be processes after we receive back the product. For both case 1 & 2, refunds will be processed and 4% restocking fee maybe levied. This fee is determined by using multiple factors, which accounts for, but is not limited to our shipping, administrative, payment gateway charges and product reorder projections.

All refunds will be processed to the original mode of payment used by the customer while placing the order. Please note it may take up-to 7 working days for the refund to reflect in your accounts, after it is processed.

Shipping & Delivery Policy

If you have ordered with us before, you must be aware that all our products are shipped with good packaging material and we take at-most care that the products have the necessary padding and cushioning for the safe transit. 

All products shipped by us will have an invoice and the pricing of all the products will be as per Indian Tax Regulations.

SMRM Innovative Ventures Private Limited will not take any liability of loss that may occur due to a delayed delivery, we only guarantee to ship your order within 2 working days from the payment date of your order, unless an unforeseen circumstance/calamity arise.

We don’t charge any separate shipping charges and the prices listed on our website are inclusive of all the costs unless otherwise specified. Most deliveries are completed within 4 to 5 business days after placing the order.

We aim to keep every item on our website in stock and our website is designed to show the availability of the items in stock, if they are available in any of our retail locations. An event may arise where multiple people are trying to buy the same item, in this scenario your payment maybe processed but the product may no longer be available with us. In this event we will inform you within 2 working days or will refund your money for the out of stock item, unless settled in an alternate way.

SMRM Innovative Ventures Private limited can only process one shipping address per order. If you want to ship to multiple locations, you are requested to process a separate order for a separate location. Please note, while we will always try to ship all items in your order together, this may not be always possible; as it is subjected to product availability and product characteristics.

Risk of Loss

All items shipped by us are pursuant to a shipment contract. This means that the risk of loss and title for the product is passed on to you upon it being delivered to the logistic carrier.

Product Description and Pricing

Radiant and its affiliates attempt to be as accurate as possible.  We, however, do not warrant that the product and its description and specifications or any other content of this site is 100% accurate, and error-free. If the product offered by us is not as described, your sole remedy is to return it to us in an unused condition. 

If you find any such error on this site, you are requested to make us aware about the same, so that we can make appropriate arrangements to not only accommodate return requests if any, but also update the correct information for our users.

Despite our best and sincere efforts, an item on our site may turn out to be mispriced, this may happen due to multiple reasons, which maybe but are not limited to rise or decrease in prices by the company; rise or decrease in taxes etc. If we discover a mispricing, we will do one of the following in the below circumstances:

• Price is lower than our stated price: We will simply charge the lower amount and ship you the item.
• Price is higher than the stated price: We will at our discretion either contact you for instructions before shipping; or cancel your order and notify you of such cancellation.

You must note that your card will be charged before your order has entered the shipping process. Except when stated otherwise, the listed price of the displayed product on our website is in Indian Rupees and the price represents the full price of the product, including shipping charges, taxes and all other costs related to the sale to make the product available to you. If you receive the product with mispricing where you have been charged higher amount, please update us.

Warranties and Limitation of Liability

This site is on “as is” and “as available” basis. We make no representation of warranties of any kind. You expressly agree that your use of this site is at your sole risk. We by no means warrant that our site, its servers, or e-mail sent by us are free of viruses or other harmful components. You agree that under no circumstances shall we be deemed liable for any damage arising from the use of this site, or the product you bought from us, including, but not limited to direct, indirect, incidental, punitive and consequential damages.

We reserve the right to correct any error, inaccuracies or omission and to change or update information at any time without prior notice. We reserve the right to refuse any order that you may place based on such erroneous, inaccurate, or out-of-date information regarding pricing, shipping, payment terms, or return policies.

To the maximum extend permitted by law we assume no liability or responsibility for: 

• Any error, mistake or inaccuracies of content displayed on the website;
• Any misinformation entered by the user;
• Any personal injury or property damage of any nature whatsoever, resulting from your access/use to our site or our product;
• Any unauthorized access to or use of our secure servers and /or any and all personal information stored therein;
• Any interruption or cessation of transmission to or from the website;
• Any bugs, viruses or the like that may be transmitted to or through our website by any third party;
• Transmission of any kind diseases/viruses by the delivery agent that you may catch while accepting the delivery of your order.
